The loss of crucial evidence may be devastating to a party’s case in litigation or settlement. There has been a recent trend in the courts of punishing litigants in a strict and unforgiving manner for improper handling of evidence. Such punishment comes in the form of unfavorable jury instructions or exclusion of expert testimony, more severe sanctions such as a dismissal of a case, monetary fines or allowing a separate cause of action for improper handling and labeling of evidence.
