Miller, Board Certified in Labor and Employment Law, to Speak on “Financial Urgency — Where Are We Now?”
David C. Miller, Esq., partner with national law firm Bryant Miller Olive, P.A. (BMO) in its Miami office, will speak at the 43rd annual Florida Public Employment and Labor Relations Forum (FPELRF) on Oct. 20. The seminar will take placeOct. 19–20 at the Rosen Shingle Creek Hotel in Orlando, Florida.
Miller and his co-presenter, Paul Donnelly, a partner with Donnelly + Gross in Gainesville, Florida, will speak about “Financial Urgency – Where Are We Now?” Miller will provide a management perspective, while Donnelly will give the union point of view.
The two will discuss this year’s Supreme Court decision in Headley v. City of Miami, and the current state of the law and pending litigation related to financial urgency. Financial urgency is a Florida labor law statute intended to permit public employers to modify labor contracts in the event of a significant financial crisis.
The financial urgency statute was used during the Great Recession by a number of Florida local governments, including the City of Miami and the City of Hollywood. There was very little judicial interpretation of the statute at the time, and considerable litigation arose as employers and unions struggled over how the law should be applied. Miller and BMO represented the City of Hollywood and filed amicus briefs in the City of Miami case.
Miller has written and presented extensively on financial urgency since 2009. He has submitted an article analyzing the history and interpretation of the financial urgency law for the March 2018 issue of the Stetson Law Review.
The 43rd annual FPELRF is jointly sponsored by the City, County, and Local Government Law Section of The Florida Bar (of which Miller is a Board member) and the Labor and Employment Law Section. It offers a total of up to 13 hours of continuing legal education credit, including certification credit in three areas.
The FPELRF is the longest-running annual seminar put on by two sections of The Florida Bar. It focuses on the labor and employment issues that affect public employers, public employees, and the unions that represent public employees.

“My first presentation on financial urgency was eight years ago at FPELRF, when none of us knew how it would be applied,” he added. “This speech will bring it full circle.”
